Effective immediately USCIS has begun accepting same sex marriage family based petitions!
The US Supreme Court ruled on June 26, 2013 that section 3 of the Defense of Marriage Act (DOMA) is unconstitutional, and following a directive by President Obama issued today, USCIS is now accepting same sex marriage family based petitions.
This means if you are a legally married gay or lesbian spouse you can now petition to emigrate your spouse or adjust their status just like any other married couple.
